On May 12, 2026 the Kansas Corporation Commission approved the line only west of US-77 in Cowley County. It denied the Flint Hills segment east of US-77 for "insufficient evidence to determine whether the route is reasonable." It ordered Evergy to study a route that "follows or parallels the U.S. 166 Right of Way to the maximum extent feasible."
The Commission wrote that it "takes seriously any activity that has the potential to permanently and adversely affect the Flint Hills or other unique ecological regions of the state."
